Two charged with conspiracy to defraud company of Ksh.1.6B land

Two men have been charged with conspiracy to defraud a company of land valued at Ksh.1.6 billion.

The accused, Atek Oteck Richard and Bernard Otieno Mallo, pleaded not guilty to allegations of defrauding Landmark Freight Services Limited of land measuring 0.6724 hectares, valued at 1.6 billion shillings, by falsely claiming to be the rightful owners of the property.  

They were also charged with forging a title deed and presenting it as a legitimate document issued by the Ministry of Lands. Additionally, they face charges of uttering a falsified allotment letter.  

Appearing before Magistrate Ben Mark Ekhubi, the two pleaded not guilty to all charges. They were granted cash bail of Ksh.200,000 each.  

The prosecution alleges that the offences were committed on unknown dates in Nairobi.

In count 1, it is alleged that the two jointly with others before court conspired with intent to defraud landmark freight services limited a parcel of land valued at Ksh.1.6 billion by falsely pretending that they are genuine owners of the land.

In another it is alleged that at unknown place within the country, with others not before court they made a false allotment letter dated July 6, 1995 in favour of Beba Freight Limited purporting it to be genuine and valid document issued by commissioner of lands.
