Supreme Court declines to proceed with Ksh.2B land case until lawyer Ahmednasir exits

The Supreme Court on Tuesday morning made good its communiqué by declining to hear lawyer Ahmednasir Abdullahi.

Ahmednasir, who was on January 18 barred from appearing before the Supreme Court, had appeared in court to represent a family in a legal battle over a Ksh.2 billion land case with the family of the late President Daniel Moi.

During the virtual hearing, the court led by Chief Justice Martha Koome said that they will not proceed with the matter if Ahmednasir is part of its defense, or any other gadget belonging to the lawyer follows the proceeding.

In this regard, the court adjourned the case, with 6 judges recusing themselves from the matter as long Ahmednasir is the one on record.

The lawyer took to his X social media platform to respond to the refusal, saying he is ready to make peace with the court on two conditions. 

"I will not take a brief or appear before the Supreme Court as long as CJ Koome, DCJ Mwilu, Smokin Wanja and Njoki are judges of the Supreme Court Kenya," Ahmednasir wrote.

"I will come back to the Court (InshaAllah) if and when Justices Ibrahim, Lenaola, Ouko and other new members constitute a majority in the Supreme Court," he outlined his 'condition'. 

A letter by the apex court that barred the Senior Counsel from appearing before it has now been adopted as a court order.

"It is the decision of this Court, that henceforth and from the date of this Communication, you shall have no audience before the Court, either by yourself, through an employee of your law firm, or any other person holding brief for you, or acting pursuant to your instructions,” read the letter sent to Ahmednasir on January 18.

The Supreme Court barred Ahmednasir on grounds that he has had continued attacks on judges and the judiciary.

“Much as this decision is bound to affect those who may have instructed you to represent them before the Court, it is untenable that you would seek justice in the very institution and before the very Judges, whose reputation and integrity you never tire in assaulting,” the letter drafted by Registrar L.M Wachira detailed.

The lawyer has since vowed to challenge the decision at the East African Court of Justice.
