National Assembly Speaker Justin Muturi has
reminded Members of County Assembly (MCAs) seeking higher electoral seats at
the August polls to tender their resignations by February 9, 2022.
According to Muturi, many MCAs might end up
being sidelined from the August General Elections if they fail to adhere to the
directive stipulated by the Independent Electoral and Boundaries Commission
(IEBC).
Muturi was speaking at his home in Nairobi,
after he attended the National Executive Council briefing of the Democratic
Party, on whose ticket he intends to vie for the presidency.
“I am just taking the liberty to advise the
Democratic Party National Executive Council that under Article 99, Clause 2,
Paragraph D of the Constitution, a sitting member of the County Assembly must
resign six months to the election date, which is tomorrow, February 9 for the
August 9 General Election,” Muturi said in a statement on Tuesday.
To add onto his sentiments, Muturi referenced
an ongoing court case filed against Gatundu North MP Wanjiku Kibe by her rival
Kungu Kaiburu who was seeking to have her term retracted on grounds that she
failed to resign from her then MCA position six months before the 2017 polls.
Waibara won round one and two of the case in
the High Court and the Court of Appeal respectively, but Kibe moved to the
Supreme Court where the case is awaiting final determination.
In order to avoid similar incidents, Muturi
told aspirants vying through his Democratic Party ticket that his party will
only clear MCAs who have already resigned ahead of the Wednesday deadline.
