Sarah Wairimu's bail application to be determined on February 18

The High Court will on February 18, 2025 rule on whether Sarah Wairimu will be granted bail in the murder case of businessman Tob Cohen.

The prosecution argues that if released, Wairimu—who is charged with the murder of Cohen—may interfere with witnesses.

"It will prejudicial for the accused person to be released before two key witnesses testify,the prosecution says it's ready to avail the two witnesses to testify as soon as possible and thereafter the accused person can renew her application for bail," prosecution lawyer Vincent Monda told court.

Meanwhile, the victim's lawyer has urged the court to issue an order barring her from accessing the house where she currently resides.  

The victim's lawyer Pearlyne Omamo told court that " it will be a grave miscarriage of justice of she was indeed allowed to go back to the scene where material evidence are.

"It's our request that the victim is barred from accessing the house which was the scene in which the victims body was retrieved," Omamo submitted.

However the defence objected to the application by the prosecution saying that there's no evidence to show that if released on bail she will interfere with the witnesses .

"We pray that she be admitted to bail ,when she was admitted to bail she complied with all court directions she's not aflight risk," defence submitted. 

Wairimu was re-arrested on January 23 after the Director of Public Prosecutions (DPP), Renson Ingonga, stated there was overwhelming evidence showing that she murdered her husband at their home in Lower Kabete. 

Wairimu was first arrested in 2019 after Cohen’s body was discovered in a septic tank at their Kitisuru home.

Murder charges against her were dropped in 2022 by then DPP Noordin Haji.
