Prosecution opposes bail for murder suspect Kevin Kangethe, cite flight risk
According to the prosecution, represented by Vincent Monda and Magdaline Nduati, several issues exist that make it difficult to release the suspect on bail.
The prosecution emphasised Kangethe is status as a flight risk, citing his immediate departure from the United States following the alleged offence, which prompted an Interpol red alert and an arrest warrant issued by a US court.
They also emphasised the gravity of the offence Kangethe is accused of committing - first-degree murder - as well as the severe potential consequences he faces, which include life in prison without parole.
The court was informed of Kangethe is conduct, which included his departure from the United States without a valid reason immediately following the alleged offence, which the prosecution claims indicates a guilty state of mind.
At the same time, the prosecution claimed Kangethe is legal status had shifted to that of a fugitive criminal under Section 2 of the Extradition (Contiguous and Foreign Countries) Act CAP 76, following his indictment in the United States.
According to the prosecution, denying bail or bond would facilitate Kangethe is extradition to the United States for trial.
Prosecutors also cited evidence of Kangethe is presence at the crime scene, such as possession of the victim's driver's licence and bank cards, under the doctrine of recent possession.
Chief Magistrate Onyina is set to deliver the ruling on this application on April 18, 2024, at the Milimani Law Courts.
