Petition filed seeking removal of Judge Maureen Onyango
The petition by MAO advocates is in respect to a case that was filed before a Nakuru Law court between Kachwai and Union Of Kenya Civil Servants
“We are aggrieved by the conduct of the court in the smatter which we believe borders on judicial misconduct on the part of the presiding judge, warranting her removal under Article 168(1) of the constitution,” reads the petition.
MAO advocates argue that on 1st August this year, they filed a case before the Nakuru court seeking orders to stop the election of Union of Kenya Civil Servants. The file was placed before duty judge Justice Mbaru Monica who directed that the matter be heard on the 18th of August this year.
They argue that the matter was not listed before the duty judge as earlier directed by the court and the file could not be traced from the registry.
“We made numerous phone calls and physical appearances to the registry, but to no avail. We followed up with emails to both the deputy registrar of Nakuru Labor court and Nairobi, but they all seemed not to know about the whereabouts of the file,” reads the letter.
They argue that they decided to write to the chief justice requesting assistance in locating the file.
“The chief justice was swift in coming to our aid, and informed us that a judgment had been rendered in the matter,” they claim
According to the advocates, they were shocked by the development and puzzled as to how the file ended before Justice Maureen Onyango under mysterious circumstances.
"We are aggrieved by the conduct of the court and we are demanding for an explanation why we were denied a chance to be heard," they submitted.
They are questioning the un-procedural summoning of the file from Nakuru , failure to inform parties, failing to inform parties of the fact that a judgment has been rendered in their matter, thereby potentially denying them their right of appeal.
