Nyamira teacher who caned pupil 107 times gets 3-year sentence

A teacher at Riang'ombe SDA Primary Boarding in Nyamira County, has been sentenced to three years in prison or a fine of Ksh. 300,000 after being found guilty of assaulting a 9-year-old student by caning him 107 times.

Keroka High Court Magistrate Eunice Nyuthu acquitted 29-year-old teacher Jackson Mobisa Marucha of attempted murder, citing insufficient evidence presented by the prosecution to support the charge.

The incident happened on March 26, 2023, when Marucha punished Titus Ondari for allegedly misplacing his school uniform.

Following the assault, the teacher went into hiding for three days.

Investigating officers, Constable Robert Mutua and Sergeant Danson Murithi, initially filed assault charges against the teacher.

However, after further investigation, the Office of the Director of Public Prosecutions (ODPP) increased the charge to attempted murder.

Speaking to the media outside the Nyamira law courts, the minor's family expressed dissatisfaction with the decision and stated their intention to appeal.
