Nganya Association wants NTSA director jailed over failure to release impounded matatus

The Nganya Association now wants the National Transport and Safety Authority (NTSA) Director of Road Safety, Dr. Andrew Kiplagat, committed to civil jail for failing to comply with court orders.

This after High Court Judge Bahati Mwamuye on Monday directed NTSA to release all impounded vehicles and return their confiscated registration plates.

Through their lawyer Danstan Omari, the association has filed contempt proceedings against the authority, accusing it of deliberately refusing to release their vehicles as instructed by the court.

Omari stated that even after accompanying his clients to the NTSA offices, the State agency still blatantly defied the said court orders.

“On February 4, 2025, at around 11a.m, the operators, accompanied by their legal counsel, visited the NTSA offices to collect their registration number plates as per the court order. However, they were met with resistance, as the NTSA refused to engage with them or implement the judge’s directives," stated the lawyer.

He added that, despite being served with the court order and given ample time to comply, NTSA officials ignored the judge’s directions.

The petitioners and their lawyers were allegedly kept waiting for over three hours without any progress.

The association is now urging the court to summon Dr. Kiplagat to explain why he should not be cited for contempt of Justice Mwamuye’s orders.

Additionally, they are asking the court to sentence Dr. Kiplagat to six months in civil jail for defying the court orders dated February 3, 2025.
