My case will never be heard until 2036; Tuju protests judicial recusal

Former Cabinet Secretary Raphael Tuju has lamented the lack of fairness by the 5 Supreme Court Judges in executing his court battle that will now cost him a decade in waiting.

Tuju has an ongoing legal battle with the East African Development Bank (EADB) over a disputed 27-acre piece of land in Karen.

According to Tuju, the judges led by Chief Justice Martha Koome recused themselves from the case and it cannot be heard until the youngest retires.

"Why did they recuse themselves? What precipitated their recusal?" he posed during an interview with Spice FM on Monday.

"It means that I will never be heard until 2036 when the youngest of them retires and therefore I'll be able to have a quorum. I have a right to be heard."

Tuju intimated that the conflict with the judges was also prompted by EADB's evidence, which he has termed false.

He said that his evidence against the bank was thrown in doubt after EADB submitted that Tuju's defense had stolen confidential papers from its Kampala offices.

He added that he was even summoned by the Directorate of Criminal Investigations (DCI) to respond to the allegations.

"They were given to me by the bank during our time of negotiation. Because I was supposed to pay 10% for this project I said I can because it was Ksh.90 million," Tuju said.

"I said that I needed assurance that you are going to disburse the rest of the loan when I pay the 10%. They said don't worry and here is the board minutes."

His sentiment lies hot on the heels of a letter he penned to CJ Koome on Friday, citing grave concerns regarding the conduct of the five Judges in executing their duties. 

Tuju explained that the Supreme Court judges have failed to uphold their solemn duty of upholding the rule of law, ensuring fair trial proceedings, and protecting the Constitution.
