MP Salasya ordered to pay businessman's Ksh.500K debt
The businessman had filed a case challenging the legislator to pay the debt he lended him on December 13, last year with the agreement that he would repay after two months.
He even produced documents from Kenya Commercial Bank (KCB) Mumias branch as evidence in court to prove that he wired the money to Salasya's bank account.
Lutta, through his lawyer Edwin Wafula, alleged that the MP had refused to pay the loan.
In his defense, Salasya denied borrowing money from the businessman, and instead claimed he is the one who loaned the claimant Ksh.1 million through his political advisor Mr. Bernard Kemba.
However, in her ruling, Magistrate Gladys Kiama dismissed Salasya's argument due to lack of evidence.
"I also note that there was nothing to support the allegations that the claimant borrowed money from the respondent, there was no evidence to support his claim," she said.
The claimant's lawyer Edwin Wafula was happy with the ruling, stating that justice has prevailed and they are ready to execute the judgement.
"We will be hoping that he settles the loan without undue duress from us, justice has prevailed, I believe in the course of law regardless of the position of someone in society, courts of law work based on evidence presented by either party," he said.
