Man jailed for 35 years for brutally killing his Form Four cousin

A Kisumu court has sentenced a man to 35 years in prison for
the murder of his cousin, a Form Four student.
The accused, Evans Omondi Ouma, was arraigned before Kisumu
High Court Judge Lady Justice Mwanaisha Sharrif who convicted him of the murder
charges and delivered the judgement.
According to the Office of the Director of Public
Prosecutions (ODPP), the court heard that the accused allegedly beat the
deceased Mark Otieno Minudi to death using a blunt object, contrary to sections
203 and 204 of the Penal Code.
“In the proceedings, the prosecution led by Mercy Mutheu
presented evidence from six prosecution witnesses, which the Honorable Court
determined proved beyond reasonable doubt that the accused unlawfully caused
the death of the deceased by assaulting him with a blunt object, resulting in
severe head injuries incompatible with life,” DPP stated on Thursday.
Lady Justice Sharrif in her ruling said the prosecution had
proved the case beyond reasonable doubt by providing adequate evidence which
convicted the suspect of the murder.
“Upon a careful evaluation of the evidence on record, the
court was satisfied that the essential ingredients of the offence of murder had
been established against the accused person,” stated the DPP.
