Lawyers found soft spot to bully MP Mutuse, Political Analyst Njoki says

Political analyst Sandra Njoki believes that the cross-examination of Mwengi Mutuse, the Member of Parliament who moved the motion to impeach Deputy President Rigathi Gachagua, was impartial.

According to Njoki, the lawyers representing DP Gachagua "were clearly bullying" the Kibwezi West MP on the floor of the Senate and were not fair in addressing the matter at hand - interrogating accusations against the Second-in-Command.

She cited an instance when Advocate Elisha Ongaya questioned Mutuse on the matter where Gachagua was accused of threatening to present a suspension case against High Court Judge Esther Maina who was prosecuting his graft case.

"Elisha kept on asking Mutuse 'Do you know the DP's lawyers submitted X,Y,Z documents to the commission?' And Mutuse kept saying my issue is not how or what he presented to the commission, my issue is that when you have a problem with a decision made by a court you make an appeal you don't go lodge a case against that judge," said Njoki speaking to Citizen TV on Thursday.

She argued that Elisha was fixated on intimidating Mutuse and did not address the submissions made by the MP against Gachagua.

"It is important to be objective if you want Kenyans to understand so that they agree or disagree with the impeachment that we give the facts impartially," added Njoki.

In the tough cross-examination session on Wednesday which lasted for over two hours, Mutuse was grilled by Gachagua's lawyers on the 11 accusations he tabled in Parliament.

Advocate Ongoya challenged Mutuse to substantiate the claims in his motion, alleging that the DP had amassed a Ksh.5.2 billion fortune since taking office as the country’s second-in-command.

Ongoya expressed disbelief at the figure, listed as one of the 11 grounds for Gachagua’s impeachment, and pressed Mutuse for clarifications.

Mutuse stumbled over his words and, despite multiple attempts to evade the question, eventually admitted that the figure was derived by estimating current land values and adding the worth of properties linked to Gachagua.

The Senate is currently holding its second hearing on the impeachment case today, Thursday, October 17, and a decision on Gachagua's ouster will be made in the evening through a voting process.
