Labour court extends orders staying promotions of 13 state counsels

Labour and Employment court has extended orders staying the promotions of 13 state counsels pending hearing and determination of case filed by Dr Benjamin Magare.

In the petition, the surgeon argued that the Attorney General and the Advisory Board effected five promotions to the grade of senior deputy solicitor general and deputy general without undertaking a competitive process.

He argues that there was no merit as 10 out 13 are from the same community and 90 percent are women.

Further, Magare argues that the advisory board has no powers to promote the state counsels.

"The fact that of the 15 top technical positions in the office of the AG available for promotion 9 were given to one community that is the Kikiyu community, the same was against the constitution," reads the petition.

He says that there are other qualified chief state counsels for the said position who would have merited through a competitive process.
