Kenyan in court to stop JKIA upgrade deal, wants Adani's proposal declared unconstitutional

A Kenyan has moved to court seeking to stop a Privately Initiated Proposal by Adani Airport Holdings Limited, which seeks to upgrade the Jomo Kenyatta International Airport (JKIA). 

In a petition filed at the Milimani law court, Isack Lango Guyo wants the court to nullify all proceedings and agreement related to the project by Adani.

He says that there was no public participation in the project and transparency, thereby infringing the constitution.

"This court declares the entire transaction including the privately initiated proposed by Adani Project Holdings and all the attendant processes related thereto as unconstitutional ,null and void ....," reads court papers 

It is his argument that the project at JKIA is marked by severe breaches of the constitution adding that the exclusion of the public from the transaction and the lack of transparency and accountability is a serious violation of the constitution.

Guyo also wants the government to be stopped from pursuing future Public-private Partnerships relating to JKIA or any other strategic national asset “without full compliance with constitutional principles of transparency, accountability and public participation.”

In a statement published on the Tuesday dailies, Prime Cabinet Secretary Musalia Mudavadi said the government has not agreed on terms with Adani Airport Holdings of India amid speculations of intentions to sell the Jomo Kenyatta International Airport (JKIA) to the private investor.

Mudavadi confirmed that the government is reviewing the proposal submitted by the Indian firm under the Public Private Partnership (PPP) in March 2024. 

Some of the renovations set to be done in JKIA include building a new passenger terminal, refurbishing the existing terminals, constructing a second runway and enhancing cargo handling facilities.
