A witness on Tuesday testified against businessman Chris Philip 'Obure' Okeyo and his bodyguard Robert John 'Bodo' Ouko in the murder of Kelvin Omwenga Ombati in August 2020.
The Office of the Director of
Public Prosecutions (ODPP), in a Wednesday release, said the witness - Kelvin
Amenya - told the High Court that Ouko lured the victim
into a room in a Kilimani apartment before shooting him.
Amenya, who is said to have been
present at the time of the crime, further stated that Ouko emerged from the
room holding a pistol while shouting that Omwenga had shot himself.
“The witness and the caretaker
drove the deceased to Nairobi Women's Hospital. He said the first accused left
the apartment while they were looking for an ambulance. He later saw him at the
hospital where the victim was pronounced dead,” stated the ODPP.
In what appeared to be an attempt
to vindicate himself, the witness said that on rushing to Kilimani Police
Station to report the incident, he found the accused already there claiming innocence.
The ODPP explained that an
attempt by the witness to confront the accused before DCIO officers led to the
recovery of the murder weapon at the accused’s house.
“When he went to Kilimani police
station to report the incident, he found the accused pleading innocent over the
killing. The witness said he confronted the accused in front of DCIO officers
on the whereabouts of the pistol. It was later recovered in a search done at
the house,” added the ODPP.
In the case, Obure was released
on a Ksh.2 million cash bail and two sureties of a similar amount by a Nairobi
court in September last year.
His bodyguard – Ouko - was freed
on a Ksh.500,000 cash bail and two sureties of a similar amount.
In a past appearance, Ouko had
told the court that he accidentally shot Omwenga in the process of taking back
his gun.
