Inside list of grounds for DP Gachagua’s impeachment

The ghosts of the mountain have returned to haunt Deputy President Rigathi Gachagua with attempts to stop his impeachment falling flat.

Majority Leader Kimani Ichungwa has confirmed that Tuesday will be the impeachment day and the much-awaited impeachment motion will be tabled at 2.30 pm.

Tabling the motion will require 233 MPs to support it to sail through, with reports indicating that as of the close of business Sunday, 302 members of parliament had appended their signatures.

If the motion sails through, National Assembly Speaker Moses Wetangula will communicate the resolution within two days to Senate Speaker Amason Kingi for action.

The Senate speaker will then convene the House and deliberate on the matter within seven days and if 45 senators out of 67 endorse the grounds, DP Gachagua ceases holding office as Kenya's deputy president.

“As MP for Kikuyu, I have appended my signature to remove (Gachagua) from office. We must stop the sabotage of government from within,” Ichung’wah said.

Citizen TV has since obtained the grounds that have been lined up in the impeachment motion which includes violation of Article 10 on the National Values and Principles of Governance on account of his public utterances which his accusers say have been inciteful, reckless inflammatory and capable of stirring ethnic hatred and balkanization.

Gachagua will also defend himself against accusations of violation of articles 147, 148,174,186 and 189 which speak to his conduct and responsibility as the principal assistant to the President.

The Deputy President is further accused of corruptly and unlawfully acquiring assets using taxpayers' money.

The assets are said to be spread in Nyeri, Nairobi and Kilifi counties.

The motion whose mover has been concealed for security reasons, has also listed violations of both national and international law, undermining the National Cohesion and Integration Act, violation of the Anti-Corruption and Economic Crimes Act, violation of the Proceeds of Crime and Anti-Money Laundering Act, violation of the Penal Code and the Leadership and Integrity Act as impeachment grounds.

In the document seen by Citizen TV, Gachagua is also facing accusations of unjustifiably and unlawfully making scathing attacks on Lady Justice Esther Maina, a judge of the High Court of Kenya and the Director General of the National Intelligence Service in total disregard of the oath of office taken by the deputy president.

Additionally, Gachagua is accused of insubordination of the president by publicly contradicting the president’s policy statements and Cabinet pronouncements.

Gachagua's fate is in the balance with President Ruto having jetted back into the country from New York with only a day left.
