Impeached Waititu suffers another setback

Governor Ferdinand Waititu’s application for review of his Ksh. 15million cash bail has been dismissed.

The High Court ruled that setting of bail is a discretion of the judiciary and also upheld the ruling that instructed Waititu to stay out of office pending determination of his case.

“It does not amount to his removal from office. I agree it only amounted to a constructive measure. Neither the judge or the magistrate purported to remove him from office. He’s still the governor…judge can’t be accused of having removed him from office,” the ruling reads.

The Kiambu Governor had sought to have his bail terms reviewed saying he was unable to raise the Ksh. 15million that the court ordered.

His lawyer Tom Ojienda further criticized the additional order barring Waititu from accessing his Kiambu County office arguing that it constitutes effective removal.

Waititu and his wife Susan Wangari are embroiled in a corruption case over an alleged Ksh. 588million tender that is said to have been irregular.

On Thursday, the Kiambu County Assembly voted to impeach Governor Ferdinand Waititu over alleged gross misconduct and abuse of office.

According to the motion, Waititu contravened the public procurement and disposal act by allegedly influencing the award of lucrative tenders to companies associated with his immediate family and close relatives.

His fate as Kiambu County Governor now lies in the hands of the Senate and the courts.
