In a preliminary objection, the Board says that the application is premature and should be struck out, adding that it did not impound his license.
“The second respondents has neither cancelled the applicant’s license nor impounded his firearm thus the allegations are apprehensive and speculative,” reads the court papers.
On his part, the Attorney General told the court that there are no orders sought against him and the proceedings should be struck out.
“That the application forms a classical description of an abuse of the due process of the honorable court,” reads court papers.
The Attorney General has also sought to be removed from the proceedings as there are no orders sought against him.
Meanwhile High court judge Jairus Ngaa has extended the orders barring the Firearm Licencing Board and the Attorney General from demanding his license without following the due process set out in the Firearms Act.
The case will be mentioned on October 11.
Jomo had moved to court challenging the State's move to revoke his firearm license, saying it is valid up to April 2024.
He wanted a court to order the Firearm Licensing Board and the Attorney General was barred from demanding his license without following the due process set out in the Firearms Act.
