Ex-NYS procurement boss jailed for seven years in Ksh.791 million fraud case

Hendrick Nyongesa Pilisi and Samuel Wachenje were jailed for conspiring to defraud NYS of Ksh.791 million in 2015.

Hendrick Nyongesa, a former head of procurement at the National Youth Service (NYS) has been sentenced to seven years in prison after being found guilty of falsifying a document contrary to Section 347(a) as read with Section 349 of the Penal Code.

Additionally, Nyongesa has been sentenced to five years in prison for breach of trust by a person employed in the Public Service, contrary to Section 127(1) as read with Section 127(2) of the Penal Code.

The court ruled that the sentences run concurrently without the option of paying a fine.

Meanwhile, the former NYS director of finance, Samuel Wachenje, was jailed to five years in prison without the option of a fine.

The two were last week convicted for conspiring to defraud the state agency of Ksh.791 million.

The court heard that Nyongesa, together with others not before the court, created a false document with the intention to defraud a Ministry of Public Works Supplies Branch circular purporting it to be an authentic document from said ministry.

The court determined that between December 1, 2014, and June 5, 2015, Wachenje and Nyongesa, both employed by the public service breached trust by processing payments that resulted in financial losses in NYS.
