EACC clears Chiloba, cites insufficient evidence to allegations of irregularity in mortgage scheme

The Ethics and Anti-Corruption Commission (EACC) has cleared the former Communications Authority of Kenya (CA) Director General Ezra Chiloba citing a lack of evidence in allegations levelled against him.

In a statement dated April 4, 2024, EACC CEO Twalib Mbarak said that the investigation team has established that there was no sufficient evidence to find Chiloba and other Authority officials guilty of the allegations among them misappropriating a Ksh.622 million staff mortgage scheme.

"The matter was closed with no further action...We recommend that the Authority reviews its Human Resource Policy and Procedure Manual," said Mbarak.

Chiloba resigned as the Authority's Director General on October 18, ending his two-year tenure at CA.

Prior to his resignation, he had not worked for the Agency since September 18, when an internal audit allegedly revealed significant losses in the CA scheme during his tenure.

As a result, he was suspended indefinitely for, among other things, allegations of abuse of office and conflict of interest.

In a letter dated October 2 and addressed to CA Board Chair Mary Mungai, Chiloba refuted the accusations as baseless and inaccurate while underscoring that all actions taken in relation to the management of the said mortgage scheme strictly adhered to relevant policies and guidelines.

Chiloba likewise raised concerns about how the scheme's audit was undertaken, further claiming that the process was interfered with.

He added that documents presented as evidence of the disciplinary action against him are full of inconsistencies and contradictions.

Meanwhile, he has been nominated to be a Consul-General in Los Angeles, USA.
