DPP seeks to overturn Waititu’s acquittal in money laundering case

The DPP is challenging a lower court’s decision that cleared Waititu and others of the charge, arguing that the magistrate erred in both law and fact by failing to convict them despite the evidence presented.
"In respect to count 12, reverse the acquittal against the 1st, 4th, 5th, 11th, and 12th accused persons, enter a conviction against each of them, and impose a sentence as prescribed by law," reads the cross-appeal.
The prosecution contends that the trial court failed to properly evaluate the evidence, which they believe demonstrated the accused’s involvement in money laundering.
They now want the appellate court to review the matter and impose appropriate legal penalties if a conviction is entered.
The case, which has been ongoing for several years, revolves around allegations of corruption and misappropriation of public funds during Waititu’s tenure as Kiambu Governor.
DPP maintains that the acquitted individuals played a role in the illicit financial transactions, necessitating a fresh review of the ruling.
Already, Waititu filed an appeal challenging the decision to convict him and is seeking to be granted bail pending appeal.
