The Director of Public Prosecutions (DPP) has urged the Kahawa Law Courts to convict and sentence two individuals linked to the 2019 Dusit D2 terror attack.
This is after the court on January 21st found that the two, Hussein
Mohamed Abdille Ali and Mohamed Abdi Ali, had a case to answer after the
prosecution proved its case beyond a reasonable doubt by presenting 45 witnesses.
According to the ODPP, the pair face terrorism charges contrary
to the law in regard to the death of 21 people.
“Hussein Mohamed Abdille Ali and Mohamed Abdi Ali are
jointly charged with conspiracy to commit an offence contrary to section 23(2)
as read with section 23(4) of the prevention of Terrorism Act, Cap 59B(POTA)
and committing a terrorist act contrary to section 4(2) of POTA,” stated the
ODPP.
“Additionally, Mr. Abdille Ali faces an extra charge of
facilitating a terrorist act, while Mr. Abdi Ali faces fourteen counts of the
same offence.”
During the trial in January, Lady Justice Kavedza in her
ruling said, “Having considered the evidence of 55 witnesses, including expert
testimonies, and the material presented before me, I am satisfied that the
prosecution has established a prima facie case against the two accused persons.
I hereby place the second accused, Hussein Mohamed Abdile, and the third
accused, Mohamed Abdi Ali, on their defence.”
