Court told DP Gachagua rightful owner of Ksh.1.5B disputed land
A
senior officer at the Ministry of Lands has said a Ksh.1.5 billion piece of land
in Nairobi County at the centre of a dispute belongs to Wamunyoro
Investments Limited, a company associated with Deputy President Rigathi
Gachagua.
Senior
Assistant Chief Land Registrar Nyandoro David Nyambaso said the title held by
Columbus Two Thousand Limited was irregularly issued since that of Wamunyoro
Investment Limited was already in existence prior and had not been legally
cancelled.
“Under
these circumstances, the title deed held by Columbus Two Thousand Limited ought
to be cancelled unless the court declares otherwise,” said Mr. Nyambaso.
On
June 18 this year, the property was transferred to Wamunyoro Investments
Limited at a consideration of Ksh.24 million.
Mr.
Nyambaso further said that on October 2, 2014, the Officer Commanding Police Station
Embakasi wrote to the Chief Land Registrar and requested verification
of the said land.
In
response, the Chief Land Registrar confirmed Wamunyoro Investments Limited’s title
deed as genuine and forming part of the registry’s record.
He
stated that the deed plan used to prepare the title for Columbus Two Thousand
Limited was a certified copy of the original deed plan annexed to that of Wamunyoro
Investments.
In
the case, DP Gachagua through his lawyer Philip Nyachoti, claims that former Director
of Physical Planning John Michael Ohas tampered with records at the land office
in a bid to rob him of the property.
The
property, he says, is charged to the Equity Bank as collateral for various
financial facilities granted to him totaling Ksh.200 million.
