Court suspends contempt of court charges against ODM elections board chairperson

Mumma was accused of disobeying court orders issued on May 14 directing the party to recognise Umoja II MCA Joseph Ndonji as the ODM nominee in the upcoming polls.

Justice Joseph Sergon issued the orders on Thursday after Mumma moved to court to appeal the decision by the Tribunal on June 14.

"That there be a temporary order for stay of execution of the ruling of the Tribunal delivered on June 14 to last until June 30", the judge ordered, further directing that a stay of the proceedings scheduled for Thursday evening last until June 30.

The application was scheduled for a hearing on June 30.

In a ruling delivered on June 14, the Tribunal found Mumma in contempt of the orders issued on May 31 which directed the party to issue a nomination certificate of Umoja II Ward MCA to incumbent Ndonji. 

The Tribunal had also nullified the certificate issued to former Umoiner tout Shadrack Machanje which the party had issued to him. 

The ODM elections board chairperson Mumma was expected to appear before the Tribunal on Thursday to show cause why she should not be jailed for six months.

The nomination dispute revolves around the nomination of Shadrach Machanje who won the primaries.
