Court orders mental assessment for MP Kagombe in boda boda rider’s murder case
Gatundu South MP Gabriel Gathuka Kagombe,
alias G.G. Kagombe, was on Monday arraigned in Machakos High Court for the offence
of murder contrary to section 203 as read with Section 204 of the Penal Code.
The particulars of the offence are that on May
17, 2024, at around 4:30 p.m. at the Kimuchu area in Makongeni, Thika West, Kiambu
County, he murdered David Nduati Wataha.
Kagombe, who was represented by a battery
of lawyers, didn't take a plea, though.
High Court judge Francis Olel has ordered
that a mental assessment be done and ordered that the accused be taken to
Kiambu Level 5 hospital on Wednesday, June 5.
“The accused should be released on
anticipatory bond terms issued in Kiambu HRCC miscellaneous application no 804
of 24 which was opposed by the state counsel on the basis of information that
has been filed and anticipatory bail was no longer applicable as it will apply
before formal charges were filed and once filed the same anticipatory bail has
been overtaken by events and the accused person will have to apply for a new
bail/bond terms once formally charged before the High Court Machakos,” ruled
the court.
On the issue of where to be charged, the
judge added that the High Court has jurisdiction all over the country.
The court ordered the accused to be brought
back on Friday, June 7, for plea taking at 10.00 a.m., and the accused be
remanded at Muthaiga Police station.
