Case against Chebukati, Raila and Kalonzo to proceed despite death of ex-IEBC chair

A case filed by activist Khalef Khalifa against former Independent Electoral and Boundaries Commission (EBC) chairperson Wafula Chebukati, Azimio leader Raila Odinga, and Wiper leader Kalonzo Musyoka will continue despite his death in February 2025. 

The matter relates to alleged to irregularities in the 2022 electoral process. 

When the matter was mentioned before High Court Judge Lawrence Mugambi, the lawyer representing Chebukati informed the court that he had no instructions on how to proceed, given that his client is now deceased.  

“I have not filed responses because the respondent is now deceased, and we are yet to receive instructions on how to proceed,” the court was told.  

Additionally, the court heard that the petitioner was supposed to file responses to an application related to the case.  

The court directed all parties to file their responses and submissions and scheduled the matter for mention on July 1 to set a ruling date.
