Waititu had sought bail citing health concerns as one of the reasons for his release.
However, in its ruling on Monday, the court stated that prison facilities are well-equipped with medical services and, in case of serious health issues, convicts are referred to a referral hospital.
The court noted that the right to bail is not automatic and that an applicant has to convince the court that the appeal is arguable and has a chance to succeed.
The court also overruled his argument that the appeal would take long in court saying that the court diary will ensure that the appeal is heard and determined in under two months since the main appeal has already been filed.
Instead, the court has directed that the main appeal be heard on a priority basis.
Waititu had filed an appeal challenging last week's lower court ruling that sentenced him to 12 years in prison or a Ksh.52.5 million fine over a Ksh.588 million graft case.
