Baringo: Daughter saves father after he was framed for ‘defiling’ her
Shockwaves hit the Kabarnet law courts in
Baringo County on Monday morning during the hearing of a case where a
middle-aged man is accused of defiling his 8-year-old daughter.
When the prosecutors cross examined the
8-year-old girl, she revealed that her mother who in this case is the
complainant framed the father.
The minor told the courts that she had
complained to the mother of stomach upset, only for her mother to change the
narrative.
The mother would then admit to the court
that she framed the husband on allegations of neglecting their children.
The court heard that the wife had recorded
a false statement at the Kabarnet police station before involving officials
from the children department and human right activists.
“I apply that the accused person be set
free as this matter be closed and the accused person be discharged
unconditionally until and unless lawfully held,” the prosecutor, Rebbeca
Bartilol told the court.
Senior Resident Magistrate Edwin Mulochi
granted the prosecution’s side their request to close the file.
“I come to the conclusion that no case has
been made against the accused person and I discharge him under Section 210 of
the Criminal Procedure Code,” ruled the court.
