Adani Group seeks exit from JKIA case as court blocks deal with gov't
The court also issued orders prohibiting the multinational conglomerate from taking over management and assets at Jomo Kenyatta International Airport (JKIA).
Justice Bahati Mwamuye's decision comes amid a legal battle over the contentious deal in which Adani would take over JKIA's operations.
The government has been ordered to provide evidence regarding the cancellation of the aforementioned contracts, with the judge scheduling the next hearing for January 2025.
Adani Group, through its lawyer Ezra Makori, has filed a request to be excused from the case, arguing that no contract between the company and the government has been finalized, and thus, there is nothing to cancel.
According to Adani's legal representatives, the agreements with the government were still in preliminary stages, and no binding contract had been signed.
The government’s lawyer, Dennis Mosota also informed the court that they had not received any formal notice or documentation concerning the cancellation of the Adani deal.
He also stated that no contract had been signed between the two parties, and thus there was no contractual obligation to be cancelled.
However, despite these claims, the case, which was filed to challenge the planned deal, is set to continue.
Lawyers for the petitioners argued that, while President William Ruto had announced the cancellation of the agreement, the court must address several complex legal issues surrounding the deal before making a final decision.
