73-year-old Dutch national jailed for 10 years, fined Ksh.3M for child pornography

A 73-year-old Dutch national has been sentenced to 10 years in jail and fined Ksh.3 million for various offences of child pornography, sexual communication with a child, indecent act with a child, and child abuse.
The accused, Jan IN’T Veld, alias Teacher Jan, Dad, and
Mzungu, appeared before Milimani Children’s Court, where he was convicted on all 10
counts of various offences of child pornography committed between April 2022
and November 2023.
“The Milimani Children’s Court found Jan IN’T Veld, alias
Teacher Jan, Dad, and Mzungu, guilty of six counts of child pornography, two
counts of sexual communication with a child, one count of committing an
indecent act with a child and one count of child abuse,” stated the Office of
the Director of Public Prosecution (ODPP).
The court heard that Jan IN’T Veld intentionally exposed a
17-year-old minor, identified as G.S., then aged 16, to obscene audiovisual
materials via WhatsApp, with the intent of encouraging the minor to engage in
sexual acts.
The accused received obscene images of two minors,
identified as A.A, aged 10, and A.B, aged 7, through WhatsApp for his own
sexual gratification
According to ODPP, Jan IN’T Veld also engaged in sexually
explicit communication with G.S. in which he encouraged the minor to
communicate in a sexual manner and indecently his private parts, thus sexually
abusing him on the same bed where the mother, who he was in a relationship
with, also lay.
The court further noted that Jan IN’T Veld actively
encouraged PW3 to engage in sexual acts with underage girls and instructed him
to take nude photos and videos during those acts, which were then sent to the
accused.
ODPP says the prosecution, through Linda Ndambiri and
Victor Preston Owuor, presented a total of nine witnesses and proved the case
beyond reasonable doubt.
The accused was slapped with the sentence and required to pay Ksh.3
million in restitution to the victims, which takes precedence over the fines.
In her ruling, Dr Alice Macharia said, “As the court of
first instance, having heard this matter from the onset, and having observed
the demeanour of the accused person and all witnesses with particular emphasis
on PW3, who testified from a place of deep hurt this court finds that the
prosecution adduced overwhelming evidence in support of all 10 counts. Each
charge has been proved both individually and collectively beyond reasonable
doubt.”
The court also ordered the accused to be deported upon the completion
of his prison term.
