Trial magistrate Dolphina Alego questioned whether the prosecution preferred to close the case and reopen it when ready, but the prosecution opposed that suggestion.
They apologized for the delay and informed the court that the two complainants—foreign nationals currently in Dubai—are willing to testify virtually.
The prosecution also requested that the defence be furnished with CCTV footage intended to be used as evidence in the trial.
The suspects face multiple fraud-related charges. The first charge alleges that between August 24 and October 19, 2024, in Nairobi, they conspired with others to defraud two foreign nationals - Sonali Purbia Malviya and Mohamed Adel - of USD 54,300 (approximately Ksh.7 million) by falsely claiming they could sell 35 kilograms of gold to Integrous Gold and Diamond Trading LLC.
The court directed that the matter be mentioned tomorrow to confirm the release of the CCTV footage to the defence. The case is set to be heard on July 29, 2025
