DPP secures 28-year jail term for duo in gang defilement case

The convicted individuals, Gift Kalu Mwango (21), and Emmanuel Kazungu Mganga (19) were found guilty of gang defiling a 16-year-old victim. The incident occurred on February 9, 2024, in Mwambetsungu, Kilifi.
According to court testimony, the victim had gone to collect her shoes at 10 PM when the two men, who lived in her neighbourhood, confronted her.
The perpetrators silenced her and forced her into nearby bushes, where Mwango sexually assaulted her while Mganga wielded a knife and intimidated her with threats of harm should she resist.
During the judgment delivery, Chief Magistrate Charles Obulutsa determined that all elements of gang sexual assault had been established, including confirmation of the victim's age, evidence of the assault, and positive identification of both defendants.
“Having considered the Prosecution’s case and defence, the court is satisfied that the prosecution has proved the main charge of gang defilement beyond doubt. The accused are found guilty and convicted accordingly,” ruled Obulutsa.
The court acknowledged that while Mganga did not directly participate in the sexual assault, he was present during the crime and could have either intervened to stop it or removed himself from the situation.
Prosecutor Ridhwan Mohamed handled the case.
