Busia man seeks Ksh.100 million from Governor over alleged assault

The petition filed at the Milimani High Court accuses Otuoma of gross misconduct over an incident said to have occurred on March 6, 2026, at Bukri Market in Funyula Constituency during a county event.
According to court documents, Yusuf Suleiman Hamisi, a 31-year-old boda boda rider, was allegedly attacked while standing in a queue for the distribution of certified maize seeds.
The petition claims the governor kicked him in the groin without provocation, an incident said to have been witnessed by members of the public and captured on video that later circulated on social media.
Through lawyer Danstan Omari, the petitioner further alleges Hamisi faced obstruction when seeking medical care at Sioport and Ruambo Sub-County hospitals, claiming the interference was linked to the governor’s office.
The incident was reported at Sioport Police Station, but court filings allege the victim began receiving threats soon after.
The petition claims unknown individuals later visited his home demanding he withdraw the complaint, and that he was briefly abducted before escaping and going into hiding.
The petitioner argues the alleged conduct violated Hamisi’s constitutional rights, including the right to dignity, security of the person, equality and fair administrative action, and amounted to a breach of leadership and integrity standards under Chapter Six and the Leadership and Integrity Act.
Among the orders sought, the petitioner wants the court to declare Otuoma unfit to hold public office, compel investigative agencies to act, and direct the Busia County Assembly to initiate impeachment proceedings under Article 181.
The petition also asks the court to ensure the victim is provided with security and medical care, and that investigations are carried out.
