Sonko wants court to dismiss Kideros application

Nairobi Governor Mike Mbuvi Sonko has urged the court to dismiss an application filed by former Nairobi Governor Evans Kidero seeking to be enjoined as an interested party in an election petition challenging his (Sonko’s) election.

Sonko, through his lawyers Harrison Kinyanjui and Cecil Miller, told High Court Judge Msagha Mbogholi that the application is an after thought and a backdoor application to challenge his election as Nairobi Governor.

The legal team for Governor Sonko submitted that the effect of the application by Kidero is to enlarge the original petition.

“My lords we ask you to disallow the application by Evans Kidero, we will suffer prejudice if he is allowed as an interested party,” argued Kinyanjui.

Kinyanjui questioned Kidero’s move to file the application 52 days after Sonko was declared winner.

“Nothing stopped Kidero from filing the application or election petition within the prescribed time,” submitted Kinyanjui.

IEBC also agreed with Sonko saying that the hounded application is an attempt to file a petition through the back door.

His lawyer Tom Ojienda submitted that nothing would stop the court from being enjoined in the case.

“No prejudice will be suffered by IEBC and Governor Sonko if Kidero will be enjoined in the election petition,” submitted Ojienda.

Ojienda said that the applicant has made out his case for his joinder and asked the court to consider the application.

“My Lord allow us to come into this thing and sort it out,” said Ojienda

The court will deliver its ruling on the application on Thursday, November 16.
