Ruaraka land saga: DPP wants Ojienda out of Swazuri team

The Director of Public Prosecution has filed an application seeking to have lawyer Tom Ojienda disqualify himself from representing Mohammed Swazuri in the Ruaraka land case.

In the application filed before the trial court, the Prosecution alleged that there was conflict of interest.

“Professor Tom Ojienda has represented NLC on several matters before various courts within the country where Mohammed Swazuri worked,” court documents seen by Citizen Digital said.

Based on the above, the prosecution wants Prof. Ojienda to withdraw  from appearing in the corruption case where Swazuri is an accused person.

The Ruaraka land saga has come under heavy scrutiny with businessman Francis Mburu claiming he owns it while Nairobi Governor Mike Sonko insisting it is public land.

In an affidavit, Swazuri urged the court to hear the reference as a matter of priority to enable the commission give direction on how to proceed with the compulsory acquisition.

He was recently arrested alongside six other suspects over claims of corruption in another case involving fraudulent compensation in the Standard Gauge Railway project.
