Prof. Kiama to continue serving as UoN Vice Chancellor  court rules

+-Prof. Stephen Kiama is set to continue serving as the University of Nairobi (UoN) Vice Chancellor after the court declined to set aside orders suspending Education CS Prof. George Magoha’s appointment of Prof. Isaac Mbeche as the institution’s VC.

Employment and Labor Relations Court Judge Maureen Onyango also directed that the case be heard inter-party on Friday and certified it as urgent.

CS Magoha had filed an application saying the court was misled by Prof. Kiama into issuing ex-parte orders adding that there’s currently a vacancy in the office of the Vice Chancellor.

The court was asked to stay or vary the orders so that the CS can appoint an acting Vice Chancellor/Deputy Vice Chancellor to enable the university continue with its critical administrative functions and to stop misrepresentation by Prof. Kiama as the institution’s boss.

Magoha, in the application, said the ex-parte orders issued on Monday in effect paralyses the proper functioning of the university, adding that there is a lacuna in the Vice Chancellor’s office and the UoN council.

“Unless the ex parte orders are set aside, the University of Nairobi is unable to undertake critical administrative functions required of the office of the Vice Chancellor and the council of UoN,” read court papers.

Magoha, through lawyer Evans Monaro, argued that despite the lacuna, Prof. Kiama has proceeded to misrepresent himself as the purported Vice Chancellor making drastic decisions as pertains the running and management of the institution and deceiving the public.

The court on Monday suspended CS Magoha’s decision to revoke the appointment of Prof. Stephen Kiama Gitahi as Vice Chancellor.

Judge Maureen Onyango issued the ruling after Prof. Kiama filed a petition challenging CS Magoha’s move to nullify his appointment and pick Prof. Isaac Mbeche as acting VC.

Prof. Kiama has since announced new appointments at the institution, further adding that he has also consented to Prof. Mbeche’s earlier request to proceed on annual leave.

In a notice dated January 21, 2020, Prof. Kiama said Prof. Madara Ogot, the Deputy Vice Chancellor (Research), has been appointed acting Deputy Vice Chancellor (Finance).
