DJ Evolve case: Court overrules decision on Babu Owinos payment of hospital bill

The High Court has faulted the lower court’s decision that ordered the MP to pay the hospital bill for Felix Orinda aka DJ Evolve.

According to Justice Luka Kimaru, the consideration for cash bail to be used for treatment for the DJ was not proper as an accused person is innocent until proven guilty.

The Judge then lowered the cash bail for Embakasi East MP to Ksh.5million from the initial Ksh.10million.

He said the MP will help settle DJ Evolve’s hospital bill only as a moral obligation and not a court order.

Justice Kimaru further noted that Mr. Owino had so far paid Ksh.4.4 million to the court that was to be used in settling the hospital bill and Ksh.600,000 directly to the health facility.

However, he noted, only the Ksh.4.4million will count as bail.

He is to deposit Ksh.600,000 with the court to secure his release.

On February 23, 2020, it was reported that Dj Evolve’s bill at the Nairobi Hospital stood at Ksh.6,684,000.

Hospital records showed Ksh1.66 million in doctors’ fees, Ksh.1.3 million in pharmacy charges, Ksh.913,683 in nursing charges and Ksh.990,000 in room cost.

Physiotherapy cost stood at Ksh.494,100 among other charges.

The family had said they could not afford to foot the hospital bill even if they sold most of their property.

They had reportedly received calls from the Nairobi Hospital to offset the bill.

Reports further indicate that the DJ who was shot on the neck was unable to speak and was being fed through tubes.
