Nephew now wants Governor Nyongo jailed in Ksh.200M family estate row

A nephew of Kisumu Governor Anyang Nyong’o now wants the county boss and his sister jailed for contempt over failure to comply with High Court orders in a family property row.

This comes after the High Court in Kisumu on October 11, 2018 ordered the governor and his sister Risper Nyagoy to include their nephews and nieces as beneficiaries of his father’s Ksh.200 million estate.

In an application seen by Citizen Digital, Kennedy Odhiambo Okuthe now wants Governor Nyong’o, his sister and three others committed to civil jail for 6 months for disobeying court orders.

Mr. Okuthe says the five were given 45 days from the date of the October 11 ruling to bring to court their father’s estate accounts since 2014 but they have failed.

He argues that the multi-million estate left behind by Hesbon Shimei Nyong’o stands to be wasted if an account is not opened for the purpose of depositing all the proceeds.

In a twist, the governor’s sister on Wednesday also withdrew an application that sought to stop them from complying with the High Court orders.

The property in contention includes 100 acres of land in Miwani as well as flats along Jogoo Road in Nairobi. Others are parcels of land in Manyatta, Tamu, Milimani estate and East Rata in Seme sub-county, Kisumu County.

High Court Judge Justice Tripsisa Cherere had previously revoked the administrative letters and certificate of confirmation of grant that placed Prof. Nyong’o and Ms. Nyagoy as the sole controllers of the estate.

Justice Cherere also appointed Mr. Odhiambo as a co-administrator of the deceased’s estate.

The county chief’s father Hesbon Shimei Nyong’o died on November 10, 2006 without a will. Mr. Okuthe later sued Prof. Nyong’o and Ms. Nyagoy for leaving out some relatives in the list of beneficiaries of the estate.
