Man who lost wife in Ethiopian Airlines crash sues Kenya Govt

The State has been sued by one of the Ethiopian Airlines crash victim’s relatives over failure to issue him with his wife’s death certificate.

Under a certificate of urgency, Henry Macharia Wairia – husband to one of the deceased persons in the plane crash – wants the court to order the Foreign Affairs Ministry to issue him with his wife’s death certificate.

According to Wairia, he wrote a letter to the ministry on May 25, 2019 asking for the death certificate of his wife.

It is his argument that despite him writing the letter, the ministry has refused to issue him with a death certificate.

Macharia, through his lawyer Irungu Kangata, argues that the death certificate is needed to facilitate him in another application seeking for compensation.

“One of the critical documents needed to effectively prosecute his claim is the death certificate which they have refused to give him, ”says his lawyer.

Kangata says that the court should order the ministry to avail the death certificate within seven days.

Wairia has also sued the Boeing Company for damages arising from the accident that killed his wife Julia Mwashi Ingasiana in March this year.

“In failing to avail the death certificate to the petitioner, the state has arbitrarily denied him his right to access to information which is required for the exercise or protection of his rights and fundamentals freedoms guaranteed in law,” reads court papers.

He has produced a marriage certificate as an annexure showing that the deceased was his wife.
