Ksh.18 million found in ex-NLC Directors home forfeited to Govt

The High Court has ordered that a total of Ksh.18 million recovered from the house of a former National Land Commission (NLC) official be forfeited to the government.

Justice John Onyiego ruled that the amount (Ksh.1 million and USD 168,900) recovered from the house of former NLC Director Valuation & Taxation, Dr. Salome Ludenyi Munubi and her husband Sostenah Ogero Tanacha amounts to unexplained assets.

“Having held that there is no sufficient or concrete explanation given as to the legitimate source of money which was under normal circumstances unusual, I am left with one logical conclusion to make; that this money was unlawfully obtained,”Onyiego ruled.

He added: “The nexus between these monies and the unlawful activity is that of money laundering, hence, the corrupt conduct associated with money whose source or legitimacy cannot be explained.”

EACC moved to court in 2018 saying that the former commissioner, Dr.Salome Munubi, had engaged in corrupt conduct and had amassed assets beyond her known legitimate sources of income.

Dr. Munubi had claimed that the money belonged to her husband Sostenah Ogero Taracha.

Upon further investigations by EACC, Taracha told the officers that the money recovered from their house was advanced to him by his daughter Risper Bwari.

Risper, who recorded a statement with the EACC, admitted that the money was her’s given by her step-father Ibrahim Issa.

However, according to EACC, investigations established that the money belonged to the former commissioner and was obtained through fictitious and fraudulent means after compensation of land acquired for SGR project.
