Ken Okoth cremation stopped after Nairobi MCA Anne Muthoni moves to court

A Nairobi court has barred late Kibra Member of Parliament Ken Okoth’s family members from cremating or burying the lawmaker pending hearing and determination of a case filed by Anne Muthoni Thumbi on behalf of a minor.

Ms. Thumbi – a Nairobi MCA – named the late legislator’s mother Angeline Okoth, his wife Monica Okoth as well as the Lee Funeral Home as respondents in the case.

The MCA moved to court claiming that the said minor is a biological son of the late legislator, adding that the family has unilaterally decided to have his body cremated so as to destroy any evidence of the minor’s lineage to the deceased.

“The mother and the wife (of the deceased) have deliberately and unfortunately opted to exclude me from the funeral and burial arrangements of Okoth,” claimed Ms. Thumbi

The court, while issuing the directive, stated that: “That in the interim a temporary injunction be and is hereby issued restraining the 1st and 2nd defendant (Okoth’s mother and wife), either by themselves, their servants or agents from conducting the burial, interment, cremation and or in any manner whatsoever dispose of the body or remains of the late Mr. Ken Okoth pending the hearing and determination of the instant application interparties.”

The court further that stated that the case will be heard on August 9, 2019 before Senior Principal Magistrate Obura.
