Human Rights body wants Supreme Courts advisory on integrity of leaders

The Kenya National Commission on Human Rights (KNCHR) has moved to the Supreme Court seeking an Advisory Opinion on implementation of Chapter Six of the Constitution on Leadership and Integrity.

KNCHR wants the court to order parties and IEBC to obtain all relevant data on aspirants and bar those with integrity questions from vying in the coming election or being appointed into public office.

Through law firm MMC Africa Law, KNCHR raises concerns Kenyans may elect into public office, persons of questionable integrity and who don’t meet requirements of Chapter 6 of the Constitution.

The commission argues High Court and Court of Appeal have issued differing decisions on Chapter Six, hampering the work of State organs tasked with vetting candidates for elective and appointive posts.

KNCHR chaired by Kagwiria Mbogori wants the CJ David Maraga led court to decide whether Chapter Six of the Constitution sets up a fit and proper test for leadership for elective and appointive offices.
