High Court bars Ngirita siblings from accessing money in KCB accounts

The High Court in Nairobi on Tuesday morning blocked the Ngirita family from accessing monies held at the Kenya Commercial Bank (KCB).

The orders were granted by Justice John Onyiego following a case filed by Opportunity Internationals Wedco Limited.

“That an order be and is hereby issued prohibiting Ngirita and her two siblings from accessing proceeds in Kenya Commercial Bank, Account Number 1109800584 pending hearing and determination of the case,” the court stated.

Phyllis Njeri Ngirita, Lucy Wambui Ngirita, and Jeremiah Gichina Ngirita were named as respondents in the case with two companies – including Platinum Credit Limited – being named as interested parties.

Justice Onyiego directed that the application dated June 28, 2019, be served upon the respondents within 7 days.

Opportunity Internationals Wedco Limited had moved to court claiming Phyllis Njeri Ngirita acquired a loan of Ksh.800,000 by offering a security in the form of a motor vehicle; Toyota Station Wagon of registration number KCH 753U.

The court heard that the company approved the said loan and deposited the money in Ms. Ngirita’s bank account held at KCB.

According to court papers however, it appears that the Assets Recovery Agency could dispose or transfer the said motor vehicle or proceed to withdraw and utilize the funds in the said account.
