Fate of former PS Omollo to be known on October 1

The High Court will make a ruling on October 1 on Lilian Omollo’s application of inviting the court to visit her farm in Siaya.

Omollo had invited the court to a certain source of the over Ksh. 35million held in several of her frozen bank accounts.

Her application follows a request by Asset Recovery Agency (ARA) to have the millions forfeited to the state on claims that they are proceeds of crime.

ARA has asked Justice Mumbi Ngugi to decline the invitation insisting that burden lies on Omollo to prove the source of the funds.

The agency has impugned the source of the funds, arguing that after visiting Omollo’s farm in Uyoma it concluded that the funds in her bank accounts could not have been from the property.

Through Mohammed Adow, ARA claims Omollo has not proved the link between the funds and the farm.

“Your ladyship,the respondent failed to prove the link between the farm and monies in her bank account; it is therefore not the business of the court to be invited to do the work of a litigant,” counsel Adow argued.

Omollo’s advocate Steven Ligunya has however implored the court to visit the farm, insisting its importance and that will be critical to give the court an objective opinion on the impugned funds.

The High Court case arose from the National Youth Service (NYS) scandal criminal case where the former Public Service PS was accused of graft.
