DPP refutes Tabitha Karanja claim that he is compromised in late Tecra Muigai case

Director of Public Prosecutions (DPP) Noordin Haji has denied claims by Keroche Breweries CEO Tabitha Karanja that he is under influence not to prosecute those responsible for the death of her daughter Tecra Muigai.

Mrs. Karanja had challenged the DPP’s bid to have the inquest into Tecra’s death transferred from the Milimani Law Courts to Lamu saying that the move poses a threat to their lives.

However, in response, the DPP said that upon perusal of the file it was established that there was insufficient evidence against Omar Lali from the charges of murder as recommended by the investigating agency.

The DPP, through Prosecutor Everlyne Onunga, claimed the decision to have the inquest conducted in Lamu was based on several factors among them that the alleged offence was committed in Lamu, and the scene of crime as well as key evidence is also in Lamu.

Further, Haji said that witnesses are based in Lamu and the evidence collected in Nairobi cannot therefore unravel the mystery of death of the deceased.

“All the critical witnesses reside in Lamu and should the case be instituted in Nairobi, they would be gravely inconvenienced,” read court papers.

The DPP said the matter will be handled professionally, refuting claims by the deceased’s family that he has an interest in the case.

“There’s no evidence that has been given to show that the DPP or any of his officers were compromised or that undue influence was exerted upon them to warrant the DPP to make the decision to enter nolle proseque,” said Prosecutor Onunga.

Omar Lali, boyfriend to the late Tecra Muigai, was in July this year set free after DPP Haji dropped murder charges against him.
