Court orders Chinese company to shutdown mining operations in Migori

A Chinese-owned company was dealt a blow on Monday after the High Court ordered it to shut down its mining operations in Migori County following a petition by Nyatike Member of Parliament Tom Odege.

Delivering the judgement, Justice G.M.A Ongondo ruled that LIJIN mining  Limited, which has been doing mineral exploration in Macalder area, Nyatike Constituency, was operating without a license in addition to polluting the environment through illegal mining of gold and copper.

Justice Ongondo of the Environmental and Land court said everyone has a right to a clean and healthy environment as enshrined in Article 42 of the Constitution.

The Ministry of Petroleum and Mining, Director of Mines and Attorney General, who had been enjoined in the case, supported the petitioner in their submissions.

According to Mr. Odege, the company had been allowed to mine in the area by an area political leader.
