Case against ex-CBK boss postponed

The case against former Central  Bank Governor, Prof. Njuguna Ndung’u was Thursday postponed after the Court of Appeal heard that the former CBK boss had appointed  lawyer Cecil Miller to represent him in a case where he is challenging the decision of the Director of Public Prosecutions (DPP) to charge him over the award of  1.2 billion shillings as security tender for the bank.

Miller takes over from  Donald Kipkorir, who represented Prof Ndung’u at the High Court over the same matter.

Appearing before justices Sankale Kantai, Jamila Mohamed and Philomena Mwilu, Ndung’u, through Miller, told the court that he had just instructed him (Miller) and needed time to file his submissions.

The court allowed his application for adjournment and directed he files his submission within ten days, the DPP and the Ethics and Anti-Corruption Commission (EACC) to file theirs’ within seven days.

The bench  further  directed that the  date for the  hearing of the appeal be set on priority basis in the month of September 2016.

Prof. Ndung’u moved to Court of Appeal after his application for judicial review was dismissed by the High Court.

He is aggrieved with a judgement of the High Court and wants the Appellate Court to make a finding that the trial  judge erred in law by dismissing his application for judicial review.
