4 cops charged with Willy Kimani murder want to be released from jail over COVID-19

The four police officers charged with the murder of lawyer Willy Kimani, his client Josephat Mwenda and taxi driver Joseph Muiruri now want to be released on bail saying that they will abide by all the conditions that the court will issue.

The four — Fredrick Leliman, Stephen Cheburet, Sylvia Wanjiku and Leonard Maina Mwangi —  have been in custody since 2016.

They claim that with the current COVID-19 pandemic their lives are at risk and could die should the virus find its way to prison.

In their application they further argue that they have been made to suffer in custody for an offence not determined by the court, adding that they may end up staying in custody indefinitely.

So far 41 of the prosecution’s 43 witnesses have testified in the case.

The matter was adjourned on Wednesday after trial Judge Jessie Lesiit raised concern over the small court in which the proceedings were to take place.

The judge said that she had requested for a big tent that can accommodate at least 100 people and directed that the court provides a bigger tent come Monday.

Head of Investigations Nicholas Ole Sena is expected to resume his testimony against the accused.
